Affidavit of Intent to Home School Revision

AFHE, with the assistance of the Home School Legal Defense Association, has created a revised version of the Affidavit of Intent to Home School for Arizona homeschoolers.

The revised affidavit includes a "Privacy Notice" which states:

The undersigned expressly prohibits the release of any and all information contained in this form including directory information as defined in 20 U.S.C. § 1232g (a)(5)(A), without prior written consent by the undersigned. See 20 U.S.C. § 1232g (a)(5)(B) and ARS § 15-141.

The goal of this revision is to help ensure the protection of a homeschooling family’s rights under the Family Educational and Privacy Rights Act of 1974 and to eliminate the distribution of directory information for direct marketing and other purposes.

If you already have an affidavit on file for your child and would like to file the revised affidavit with your county school superintendent, we suggest the following:

  1. Complete the revised affidavit and have it notarized as you did with the previous version.
  2. Make a copy for your records.
  3. Write a brief letter asking the county school superintendent to replace the affidavit currently on file with this new one. Thank them for their cooperation in protecting your family's privacy.
  4. Since a copy of the child's birth certificate is already on file with county school superintendent's office, it should not be necessary to re-send the birth certificate.

NOTE: Filing a replacement affidavit is optional and at the parent's discretion. It is not a requirement for any family with an affidavit already on file to submit the revised version.
